Weighplate Europe AB is the seller of products purchased through this online store.

Our store is hosted on Shopify, which provides the e-commerce platform that enables us to offer our products and services online.

2. SCOPE OF THESE TERMS

These terms apply to purchases made by consumers through our online store as well as to your use of our website and related services.

If mandatory consumer protection laws in your country provide you with more favourable rights than these terms, those mandatory rights will continue to apply.

You must have the legal capacity required under applicable law to enter into a purchase agreement with us.

3. PRODUCTS AND PRODUCT INFORMATION

We aim to provide accurate and up-to-date descriptions, images, specifications, prices, and other information about our products.

Minor differences in colour or appearance may occur due to screen settings, photography, manufacturing tolerances, or product updates.

Product information available on our website and through the Weighplate app is intended to help users understand and track food weight, calories, and nutritional information. Such information is provided for general informational and wellbeing purposes and should not be considered medical advice or a substitute for advice from qualified healthcare professionals.

Customers are responsible for following the product instructions and care guidance provided with the product.

4. ORDERS AND CONTRACTS

When you submit an order through our online store, you are making an offer to purchase the products included in your order.

After your order has been submitted, you will normally receive an electronic confirmation.

A binding purchase agreement is formed when we accept your order.

We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of obvious pricing errors, suspected fraud, payment issues, lack of product availability, or where we are unable to fulfil the order.

If payment has already been made for an order that we cannot accept or fulfil, the applicable amount will be refunded.

Consumers retain any statutory right to cancel an order before delivery in accordance with applicable consumer law.

5. PRICES, TAXES AND PAYMENT

The price displayed for a product is the price applicable when the order is placed, subject to correction of obvious errors.

For consumer sales, where required by applicable law, displayed prices include VAT or other applicable sales taxes.

Any applicable shipping costs will be clearly shown before you complete your purchase.

If customs duties, import taxes, or other charges may apply to a cross-border order, information about how such charges are handled will be provided during the checkout process or in our Shipping Policy.

You will always have the opportunity to review the total amount charged by us before completing your purchase.

6. SHIPPING AND DELIVERY

We deliver to the countries and regions made available through our online store.

Available shipping methods, shipping costs, and estimated delivery times are displayed at checkout and/or explained in our Shipping Policy.

Delivery dates and delivery times are estimates unless we expressly state otherwise.

We will make reasonable efforts to deliver your order within the stated timeframe. If a significant delay occurs, we will, where reasonably possible, provide information about the delay. Your statutory rights in the event of delayed delivery are not affected.

Where we arrange the shipping, the risk of loss of or damage to the goods remains with us until you, or a third party designated by you who is not the carrier, physically receives the goods.

If you independently engage a carrier that was not offered by us, the risk may, in accordance with applicable law, pass when the goods are handed over to that carrier.

7. UNCOLLECTED PACKAGES

If a shipment is delivered to a service point, parcel collection point, or other selected pickup location and is not collected within the carrier’s specified holding period, resulting in the shipment being returned to us, we reserve the right to charge a fee of SEK 250.

The fee is intended to cover reasonable costs that may arise as a result of the uncollected shipment, including original shipping costs, return shipping costs, and handling of the returned shipment.

The fee will only be charged to the extent permitted by applicable law and provided that information about the fee formed part of the terms applicable when the order was placed.

Failing to collect a package does not in itself constitute notice that you wish to exercise your right of withdrawal. If you wish to withdraw from your purchase, you must clearly notify us in accordance with the section on the right of withdrawal below.

If you validly notify us that you are exercising your statutory right of withdrawal, the return will be handled in accordance with the withdrawal and return provisions below. You will only be responsible for costs that we are entitled to charge under applicable law and that you were informed about before the purchase.

8. RIGHT OF WITHDRAWAL

If you are a consumer and have purchased a product at a distance, you will normally have a statutory right to withdraw from your purchase without giving any reason.

For consumers covered by EU/EEA distance selling rules, the withdrawal period is generally 14 days from the day after you, or a person designated by you, receive the goods, subject to any applicable statutory exceptions.

To exercise your right of withdrawal, you must clearly inform us of your decision within the withdrawal period.

You do not need to provide a reason for exercising your statutory right of withdrawal.

After notifying us, the goods must normally be returned without undue delay and no later than 14 days from the date on which you informed us that you were withdrawing from the purchase.

Unless otherwise agreed, you are responsible for the direct cost of returning the goods when exercising your right of withdrawal, provided that we informed you of this responsibility before the purchase.

You may inspect the product to establish its nature, characteristics, and functioning. You may be responsible for any reduction in value resulting from handling beyond what is necessary for such an inspection, to the extent permitted by applicable law.

9. REFUNDS WHEN EXERCISING THE RIGHT OF WITHDRAWAL

If you validly exercise your statutory right of withdrawal, we will refund the payments received from you in accordance with applicable law.

This includes the cost of our least expensive standard delivery option where required by law. Additional delivery costs resulting from your choice of a more expensive shipping method do not have to be refunded where permitted by law.

Refunds will normally be made using the same payment method used for the original transaction unless otherwise agreed.

We may withhold the refund until we have received the returned goods or until you have provided evidence that the goods have been sent back, whichever occurs first, where permitted by applicable law.

10. FAULTY, DAMAGED OR INCORRECTLY DELIVERED PRODUCTS

Your statutory rights regarding defective, damaged, incorrectly described, or incorrectly delivered products are separate from your right of withdrawal.

Please provide your order number and information that allows us to understand the issue. We may request photographs, videos, or other reasonable information where necessary to assess the problem.

If the product is defective or otherwise does not conform to the purchase agreement, you may be entitled to repair, replacement, a price reduction, termination of the purchase, and/or other remedies in accordance with applicable consumer law.

We will not charge you return shipping costs that we are legally required to cover in connection with a valid claim relating to a defective product.

11. STATUTORY RIGHTS AND WARRANTY

Consumers purchasing from Weighplate Europe AB have statutory rights in addition to any commercial warranty that we may offer.

For consumers covered by Swedish consumer law, the statutory right to make a complaint regarding an original defect generally applies for three years in accordance with the Swedish Consumer Sales Act.

Consumers in other countries retain the mandatory statutory rights applicable to them.

Where Weighplate offers a 2-year commercial warranty, this warranty is an additional benefit and does not replace, limit, or restrict any statutory consumer rights or complaint periods.

Any specific terms applicable to a commercial warranty will be provided separately.

12. THE WEIGHPLATE APP AND DIGITAL FEATURES

Certain functions of Weighplate products may interact with the Weighplate app, Bluetooth functionality, mobile devices, operating systems, or third-party services.

The availability of certain app features may depend on your device, operating system, country, and software version.

We may update or improve our software and digital services from time to time.

Nothing in these terms limits any statutory obligations that we may have regarding digital elements, software updates, conformity, or functionality.

We do not guarantee that third-party networks, operating systems, app stores, or services outside our control will always be available without interruption.

13. PERMITTED USE

You may only use our website and services for lawful purposes.

You must not intentionally interfere with the security or operation of our website, attempt to gain unauthorised access to our systems, distribute malicious software, misuse customer or company information, impersonate another person, or use our services for fraudulent or unlawful activities.

We may restrict access to our services where reasonably necessary to protect our customers, our systems, or our legal rights.

14. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise stated, the content on our website, including our trademarks, product names, logos, text, graphics, photographs, videos, software, designs, and other content, is owned or licensed by Weighplate Europe AB or its affiliated companies.

Such content may be used for personal and non-commercial purposes in connection with visiting our website or purchasing and using our products.

You may not reproduce, distribute, commercially exploit, or otherwise use our intellectual property without permission, except where permitted by law.

15. THIRD-PARTY SERVICES

Our website and services may use or link to third-party services, including Shopify, payment providers, shipping carriers, app stores, and other technology providers.

These third parties may provide their services under their own terms and privacy policies.

We are not responsible for third-party services to the extent that an issue genuinely falls outside our responsibility or control. However, nothing in this section limits our responsibility to you where applicable consumer law makes us responsible for fulfilling our agreement with you.

16. LIMITATION OF LIABILITY

Nothing in these terms excludes or limits liability where doing so would be prohibited by applicable law.

In particular, these terms do not limit your mandatory rights under consumer protection rules, product safety rules, product liability law, or other applicable legislation.

To the extent permitted by law, we are not responsible for losses caused solely by circumstances outside our reasonable control or by improper use of a product contrary to the instructions provided.

17. EVENTS OUTSIDE OUR CONTROL

We may experience delays or difficulties caused by events outside our reasonable control, such as disruptions to transportation, telecommunications, payment systems, natural disasters, government actions, or other exceptional events.

Where this occurs, we will take reasonable steps to minimise the consequences.

Nothing in this section removes any mandatory rights you may have in the event of delayed or failed delivery.

18. PRIVACY AND PERSONAL DATA

We process personal data in accordance with our Privacy Policy and applicable data protection law.

As our online store is provided through Shopify and we use other service providers to operate our business, certain personal data may also be processed by those service providers in accordance with applicable data protection requirements.

19. CHANGES TO THESE TERMS

We may update these terms from time to time, for example to reflect changes to our business, products, services, or applicable law.

The terms applicable to an individual purchase will normally be those in force at the time the purchase was made.

Any changes will not retroactively remove mandatory rights that you already have.

20. APPLICABLE LAW AND CONSUMER DISPUTES

These terms are governed by Swedish law.

However, if you are a consumer resident in another country to which we direct our business activities, the choice of Swedish law does not deprive you of any mandatory consumer protection rights that you are entitled to under laws that would otherwise apply.

We encourage you to first contact us at support@weighplate.com so that we can attempt to resolve any complaint.

Consumers may also have the right to have a dispute reviewed by an alternative dispute resolution body. In Sweden, consumer disputes may, where applicable, be referred to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), which reviews disputes between consumers and businesses.

Nothing in these terms prevents either party from bringing a matter before a competent court where permitted by applicable law.

21. SEVERABILITY

If any provision of these terms is found to be invalid, unlawful, or unenforceable, that provision will only be applied to the maximum extent permitted by law.

The remaining provisions will continue to apply.
